About Sean Gallagher
Sean Gallagher has more than 20 years of courtroom experience covering a broad range of complex litigation, including commercial, employment, and public policy matters. He has handled commercial litigation matters involving claims for fraud and misrepresentation, securities fraud, antitrust violations, consumer protection violations, trademark and copyright infringements, environmental whistleblowing, violations of the False Claims Act, and corporate governance disputes.
Mr. Gallagher has also handled a broad spectrum of public policy, election, and constitutional matters. He has significant experience bringing and defending First Amendment free speech and religion matters. In October 2010, he won a First Amendment case in the United States Supreme Court in which he represented a member of President Bush’s advance team, when the Supreme Court, over the written dissents of Justices Ginsburg and Sotomayor, declined to reverse the U.S. Tenth Circuit’s determination that the president could remove the plaintiffs from a White House event based upon the content of their speech. Weise v. Casper, -- U.S. --, 131 S.Ct. 7, 178 L.Ed.2d 314. He has also represented the governor of Colorado in the state's congressional redistricting litigation, a U.S. Congressman in a congressional race recount and members of the Vice President's Secret Service detail in federal civil rights litigation. He also represents clients bringing constitutional and statutory challenges to federal and state agency actions.
As an adjunct to his litigation practice, Mr. Gallagher has nationally recognized experience in the developing field of electronic discovery. He is a member of The Sedona Conference’s Working Group on Best Practices for Electronic Document Retention and Production, and recently helped lead a team which drafted the conference’s newest commentary on “Proportionality in the e-Discovery Process.” About Jeffrey Kass
Jeffrey Kass is a shareholder in the firm's Intellectual Property and Business Litigation practice groups. He has more than 15 years of experience representing clients in many areas of law. He practices out of Polsinelli Shughart's Denver and St. Louis offices.
Mr. Kass focuses his practice on trademark, copyright and patent litigation, as well as technology law, business and commercial litigation, broker-dealer arbitration and business planning matters. His practice also focuses on contract issues, software licensing, Internet domain name disputes, and related areas of law. He is experienced handling preliminary injunctions and temporary restraining orders, jury and non jury trials, disputes before the Patent & Trademark Office, and he has participated in securing multiple intellectual property victories in federal court, including winning a significant trademark jury victory in 2009. He also advises companies on various business planning issues, and he is general counsel to multiple startup companies. In 2009, the publication Small Business Monthly named Mr. Kass one of the top ten lawyers for entrepreneurs.
Mr. Kass is the author of numerous articles, and he has given many presentations to businesses and lawyers, on a wide range of IP, litigation, and business related topics. He also is an adjunct law professor teaching IP litigation. He is a member of the board of directors of the St. Louis County Economic Council Enterprise Centers, among many other commitments to professional and community service.
