Insurance regulatory and compliance issues form the framework for Jennifer L. Osborn’s practice, with a primary focus on health insurance matters on a national basis.  Insurance companies and third-party administrators appreciate Ms. Osborn’s work with financial and market conduct examinations, policy form filings, and assumption reinsurance transactions.  Ms. Osborn is well versed in state health insurance laws and regulations, particularly mandated benefits, as well as federal laws affecting the sale of health insurance, such as HIPAA, ERISA and telephonic seller requirements.  Ms. Osborn also assists medical discount card companies with licensing, registration and compliance issues. 

 

Ms. Osborn has assisted insurance companies with licensing and redomestication issues, holding company act issues, acquisitions, reinsurance, and affiliated transactions.  She has also developed expertise with unfair trade practice laws and advertising requirements affecting insurance companies and agents.

 

With her litigation background, Ms. Osborn has also defended insurance companies and agents against allegations of negligence, fraud, misrepresentation, bad faith refusal to pay and wrongful rescission before state insurance departments and in federal and state courts. Clients also turn to Ms. Osborn for representation in license revocation and other disciplinary proceedings.
