Senior Housing & Long Term Care (Assisted Living, Independent Living, Skilled Nursing Facilities, CCRCs) – Work with clients to develop new assisted living facilities in a variety of states. Advise clients on compliance with state and federal law, including certification and licensure issues. Advise clients on business planning. Assist clients in addressing zoning and entitlement issues. Draft provider contracts and agreements including vendor contracts under the Prospective Payment System. Draft resident contracts and litigate related issues. Represent providers in administrative hearings including audit hearings, termination actions, and complainant hearings. Assist clients in settling Life Safety Code disputes with both state and federal authorities. Assist clients in responding to certification and accreditation surveys. Assist municipalities in drafting local ordinances to address long term care and senior housing issues.
CON/Health Planning – Assist clients in applying for Certificates of Need and Certificates of Exemption. Represent existing health care providers in opposing applications including the litigating complaints for administrative review. Counsel clients regarding coordination of project development with the Certification of Need application process. Assist clients in requesting declaratory rulings on interpretations of the Illinois Health Facilities Planning Board’s rules.
Fraud and Abuse – Assist clients in a variety of health care fields in responding to subpoenas and investigations by the Office of the Inspector General, the Federal Bureau of Investigation, State Medicaid Fraud Control units and State police. Assist clients in responding to audits conducted by Medicaid, Medicare and the Office of the Inspector General including representing clients in audit appeals. Reduced joint Medicare/Office of Inspector General audit from $1.1 million to $325,000. Counsel clients regarding investigation and resolution of compliance concerns. Review business arrangements and agreements and draft opinion letters regarding compliance with state and federal fraud and anti-kickback laws. Develop compliance plans for clients and assist in their implementation including training and ongoing monitoring. Conduct fraud audits and compliance training for clients. Assist clients in refunding overpayments. Assist clients in voluntarily disclosing compliance issues to the Office of the Inspector General.
Medicare and Medicaid Reimbursement – Advise clients on enrolling in Medicaid waiver programs for assisted living. Represent clients in reimbursement disputes including medical necessity determination appeals. Advise clients regarding TEFRA reimbursement and rebasing. Successfully appealed intermediary interpretation of denial of payments resulting in $200,000 gain for client. Draft opinion letters regarding various issues of reimbursement including coverage, limitations, and reporting requirements.
Pharmacy and Pharmaceutical Law – Advise pharmaceutical manufacturers regarding complying with regulatory requirements (state and federal). Advise pharmacists and pharmacy technicians regarding civil liability. Assist pharmaceutical and medical device manufacturers in responding to FDA inspections and in completing New Drug Applications and Abbreviated New Drug Applications. Represent pharmacists, pharmacy technicians, and pharmacies before state boards of pharmacy and the FDA regarding the issue of compounding versus manufacturing. Drafted regulations for the Illinois State Board of Pharmacy for automated pharmacy dispensing systems. Advise clients regarding compliance with the Prescription Drug Marketing Act and avoiding liability under the Medicare and Medicaid Fraud and Anti-kickback statute.
