Amy values her role as a trusted litigation partner for businesses and individuals. She navigates the civil litigation process for clients while focusing on each client’s business needs, respecting that unique business perspectives impact each client’s litigation goals. Whether collaborating directly with the client or assisting national or in-house counsel as their local counsel in Kansas or Missouri, Amy works to obtain results in all aspects of civil litigation, including pretrial, trial, appeals, and alternative dispute resolution. Amy’s experience in business litigation includes a wide variety of commercial issues, including:

  • Trade secrets
  • Noncompetition agreements
  • Breach of fiduciary duty
  • Contract disputes
  • Fraud, conversion, and other business torts
  • Handled oral argument on behalf of state agency before the Kansas Supreme Court, representing agency under appointment as Special Assistant Attorney General.
  • Defended company accused of misappropriation of trade secrets, successfully resulting in dismissal of all but one claim on summary judgment. Remaining claim defended by law partner at two-week jury trial with complete defense verdict.
  • Defended executives accused of misappropriating trade secrets when leaving employment with a publicly traded company to work for a competitor. Resulted in the dismissal of the case by the plaintiff.
  • Defended a small business and its principals in a contempt hearing involving the alleged violation of the court’s preliminary injunction orders, resulting in the court’s rejection of contempt sanctions and the dissolution of the preliminary injunction order.
  • Defended a law firm in a legal malpractice action involving an attempt by the firm’s former clients to rescind a settlement agreement reached in an underlying case. Obtained summary judgment on all counts in favor of the law firm.
  • Defended a publicly traded company in a lawsuit brought by former employees who sought damages for the failure to construct a medical office building. Resulted in settlement during trial.
  • Obtained a defense verdict in favor of a municipality in a personal injury action brought by a pedestrian injured after falling on an allegedly improperly maintained residential street.
  • Defended a municipality in an action seeking injunction against the redevelopment of a municipal golf course. Obtained summary judgment and maintained result when appeal was dismissed by a court of appeals.
  • Defended a media company in a lawsuit related to purported stock options granted to a former employee, resulting in settlement before the closing argument at trial.
  • Defended a health care company in an arbitration action where the claimants sought specific performance of employment agreements providing for adequate equipment and facilities and reasonable non-physician personnel. Resulted in award in favor of client.
  • Defended an aircraft assembler in a lawsuit involving an alleged Uniform Commercial Code breach of contract in the sale of a jet aircraft. Resulted in a favorable jury verdict by trial team.
  • Represented an aircraft assembler in a lawsuit against its component parts manufacturer for breach of contract, breach of warranty, and fraud claims. Obtained key summary judgment ruling in favor of the client, leading to settlement of the case weeks before trial.
  • Represented a local company in an intellectual property lawsuit against a competitor who deceived consumers by infringing on the client’s trade name. Resulted in mutual resolution of matter with the adversary.
  • Defended an insurer in a lawsuit involving denial of coverage for a fire loss. Obtained summary judgment on the plaintiffs’ claim for the tort of outrage.
  • Defended a health care company in a preliminary injunction evidentiary hearing involving assignment of employment contracts as part of the proposed sale, transfer and assignment of hospital assets. Resulted in denial of plaintiffs’ requested relief.
  • Represented a company in a federal court injunction action regarding ownership and possession of intellectual property by two parent companies. Resulted in mutual resolution of matter.
  • Defended a state commission in action by taxpayers seeking a permanent injunction against proposed gambling facilities in Kansas. Obtained ruling from court dismissing action.
