With an emphasis on products liability and insurance coverage matters, Cary W. Hall thrives on managing complex litigation. His practice handles products liability, mass tort, insurance coverage and commercial litigation for major manufacturers, pharmaceutical companies, transportation companies, and other businesses. Cary also serves as the Chair of the firm’s Products Liability practice, where he counsels clients and litigates cases involving failure to warn or maintain, design defect, and manufacturing defect claims. Cary is a sustaining member of the Product Liability Advisory Council (PLAC).  Additionally, Cary serves as Chair of the Phoenix office Recruiting Committee.

Cary was recently elected a Fellow in the American College of Coverage and Extra Contractual Counsel, an organization which admits less than 1% of the lawyers in the United States. His insurance coverage practice involves counseling and litigation on behalf of corporate policyholders with respect to:
  • Designing insurance coverage strategies 
  • Conducting policy review 
  • Advising on policy implications resulting from lawsuits and claims 
  • Breach of contract 
  • Bad faith litigation

Cary also advises, counsels, and litigates cases for pharmaceutical companies in products liability and insurance matters arising from clinical trials of investigational drugs.
  • Representation of recreational products manufacturer in lawsuit alleging toxic exposure to Beryllium.
  • Successfully argued to exclude a plaintiff's expert from testifying in a lawsuit in which the plaintiff sought $50 million in damages for an alleged traumatic brain injury. After a two-week jury trial, the trial court granted a motion for a non-suit based on plaintiffs' failure to prove its case in chief.
  • Obtained summary judgment against 110 plaintiffs seeking more than $10 million, alleging mold exposure in their apartment complex.
  • Obtained a $2.3 million default judgment against an emissions testing provider and an assignment of rights to pursue against its insurance carriers.
  • Investigated employee theft allegations against a former employee. Obtained a recorded confession from the employee and full restitution of more than $100,000.
  • Successful prosecution of insurance coverage against insurers of the World Trade Center after the 2001 terrorist attacks. Action was on behalf of the main lender to World Trade Center investor, obtaining more than $500 million.
  • Obtained successful settlement for an international manufacturer of power tools and equipment after limited discovery demonstrated improper use of the power equipment.
  • Ongoing litigation involving prosecution of insurance coverage for directors and officers malfeasance.
  • Successful representation of a pharmaceutical company in the prosecution and appeal of claims seeking insurance coverage for mass tort claims arising out of alleged HIV- and HCV-tainted blood products. Obtained more than $250 million in insurance coverage.
  • Obtained summary judgment in personal injury case against biopharmaceutical company based on a patient's informed consent to participate in clinical trials of investigational drugs. Served as national coordinating counsel of more than a dozen such suits.
