Daniel Farris isn’t your ordinary geek.  As a former software engineer and network administrator in the telecommunications industry, Daniel offers his clients real-world experience in fiber optic networking, data center operations, cloud computing, mobile app development, and data privacy and security matters.  His practice is founded upon understanding how technology can strengthen and expand the core mission of his clients’ businesses.

Daniel co-chairs Polsinelli’s Data Center & Infrastructure and Data Privacy & Security teams, and serves clients in a variety of industries, ranging from telecommunications and technology companies to healthcare providers, financial institutions, national retail and apparel companies, and manufacturing clients.  He represents clients both large and small, serving on the firm’s Startup Ventures team to assist startups, embryonic, and emerging growth companies on a variety of technology and intellectual property matters, as well as acting as a trusted advisor to Fortune 500 technology and branded/portfolio companies.

Although Daniel’s practice is primarily technology focused, he also represents clients in a range of traditional intellectual property matters, including inbound/outbound licensing, Digital Rights Management matters, trademark prosecution, brand extension deals, and support of mergers and acquisitions.  Daniel has experience in the following areas:

Daniel also assists clients in protecting the intellectual property and proprietary information from unauthorized disclosure or use by current or departing employees.

  • Represent the owner and operator of a 900-mile 144 strand fiber optic telecommunications network, serving public and private clients through dark fiber leasing, broadband capacity agreements, and layered network services.
  • Serve as outside technology counsel for the owner and operator of 6,000,000 square foot underground data center facility, handling dark fiber, capacity, collocation, closet, and meet me room negotiations and agreements. 
  • Performed regulatory compliance and privacy audit of a Fortune 500 company with internal and external data flows spanning dozens of countries around the world. 
  • Negotiated a multimillion dollar enterprise wide professional and hosted services agreement for delivery of operational and billing SaaS product to a major U.S. healthcare system. 
  • Drafted and revised approximately 15 enterprise-wide internal privacy, security, access, and technology use policies for a well-known large cap technology company. 
  • Represented a nonprofit telecommunications company to build, operate, and license statewide fiber optic broadband network, using fiber, cable, point-to-point wireless and microwave over last-mile lateral segments to develop a high speed health care network to facilitate the use of EMR and implementation of HIEs.
  • Advised client regarding response obligations, agency and public notice, and best practices to quickly and effectively identify, contain, and remedy a data breach involving PII and PHI. 
  • Developed and negotiated new form collocation, carrier hotel, and managed services agreements for a national data center operator. 
  • Counseled a Fortune 500 company on breach analysis and potential obligations related to the theft of encrypted laptops and mobile devices. 
  • Represented a federal contractor on a variety of matters related to the licensing and implementation of hardware, SaaS (software), and other cloud solutions related to homeland security, emergency management, preparedness, planning, response and recovery. Client's model integrates a variety of communications methods, from secure wireless to cellular to radio, to deliver real-time intelligence and information to first responders. 
  • Represent Fortune 500 apparel company in merchandise licensing, brand extension licensing, and event sponsorship.
  • Represented a manufacturer of nutraceuticals and dietary supplements in matters ranging from corporate structure and governance to intellectual property protection, enforcement, licensing, marketing/advertising and product distribution. 
  • Managed and negotiated in-bound licensing of enterprise cloud solution to support large national hospital system as part of a multi-billion dollar deal. 
  • Managed and negotiated deals to move major health care system’s and employee benefits provider’s data centers to new, primary outside facilities, including collocation and managed services.
