Graham Day has spent nearly 20 years capitalizing on efficiency and creativity to solve a wide range of issues for clients. He is adept at recognizing the business realities of a given situation and then utilizing his experience to meet clients' goals.

 

Graham is a shareholder in the Intellectual Property Litigation practice group. He is also a member of the Commercial and Business Litigation practice group, as well as the Probate and Fiduciary Litigation practice group.

 

He focuses his practice on handling a wide variety of business litigation matters through trial and appeal with an emphasis on patent litigation, trademark litigation, trade secret litigation, copyright litigation, and other forms of intellectual property litigation.

 

Graham has extensive experience litigating intellectual property matters in courts throughout the country, and is a member of the bars of several U.S. District Courts, as well as the State Bars of California, Missouri, and Illinois.  He also has substantial experience with all forms of alternative dispute resolution, including arbitration and mediation, and is the author of "Building a Platform for Success," in Alternative Dispute Resolution Client Strategies (2007). In addition, his experience extends to numerous other substantive areas, including probate and fiduciary litigation, real estate litigation, insurance coverage litigation, as well as general commercial and contract litigation.

  • Successfully defended plastic stool design company in Internal Trade Commission Investigation and patent litigation in United States District Court for District of Colorado brought by competitor.  Both the ITC Investigation and litigation were voluntarily dismissed after eliciting deposition testimony evidencing the invalidity of the asserted patent.
  • Successfully obtained injunctions and substantial financial settlements in several copyright infringement actions in the U.S. District Court, District of Kansas on behalf of internet filing company.
  • Successfully represented generic pharmaceutical company as plaintiff in patent infringement action in the United States District Court for the District of Delaware.  The case settled on favorable terms.
  • Obtained multi-million dollar settlement on behalf of St. Louis Produce Market Inc. against several issuers with respect to roof damage sustained as a result of an ice storm.
  • Successfully represented mini-bike manufacturer in patent, trade secret and trademark litigation in the United States District Courts for the Western District of Missouri and Northern District of Texas.  The cases settled on favorable terms.  
  • Successfully defended nutritional supplement manufacturer in multiple patent litigations in the United States District Courts for the Central District of California and Southern District of California.   The cases settled on favorable terms.
  • Successfully represented telecommunications company in patent infringement action in the United States District Court for the Northern District of California involving telecommunications technology.  The case settled on favorable terms. 
  • Successfully defended pet grooming tool manufacturers in multiple patent litigations in the United States District Court for the Eastern District of Missouri. The cases settled on favorable terms. 
  • Successfully defended bank in patent infringement action in the United States District Court for the Northern District of Illinois involving card processing technology.  Obtained summary judgment on behalf of client.  
  • Successfully represented generic pharmaceutical company as plaintiff in patent infringement action in the United States District Court for the Southern District of New York.   The case settled on favorable terms on the eve of trial.
  • Successfully defended professional football team in copyright litigation in the United States District Court for the Western District of Missouri.  The case settled on favorable terms.
  • Successfully defended nutritional supplement company in patent and trademark infringement litigation in the United States District Court for the Northern District of Illinois. Obtained favorable claim construction ruling following Markman briefing.  The case settled on favorable terms thereafter. 
  • Successfully represented inventor in patent litigation regarding surgical apparatus in the United States District Court for the Western District of Missouri.  The case settled on favorable terms.
  • Successfully represented agricultural products company in trademark litigation in the United States District Courts for the Eastern District of Missouri and the Eastern District of Pennsylvania.   The cases settled on favorable terms after we prevailed in jurisdictional dispute.
