Jennifer Growcock is well-versed in trial and appellate practice. Her unique array of litigation and appellate experience empowers her to represent clients’ litigation needs. While Jennifer primarily practices in the areas of commercial and employment litigation, the history of her practice allows her to handle many types of cases under those umbrellas, whether those matters are before state or federal agencies, courts, or appellate courts. Her experience qualifies her to handle all aspects of a case, both before and after claims have been filed. She is also skilled in alternative dispute resolution, including the handling of mediations and arbitrations. Jennifer’s experience breeds her confidence in the courtroom. She has significant experience in:

  • Handling major cases by resolving cases in the pretrial stages and through negotiation, mediation, and arbitration.
  • Trying complex commercial and employment litigation matters in state and federal courts.
  • Drafting and arguing appellate matters before the Missouri Court of Appeals and Missouri Supreme Court.
  • Representing employer clients on claims filed with state and federal courts and human rights agencies on discrimination matters, trade secrets claims under the Missouri Uniform Trade Secrets Act, non-compete agreements, unemployment compensation and eligibility proceedings, and unfair competition issues.
  • Advising employer clients on day-to-day personnel management issues, including Family Medical Leave Act, hiring and termination issues, and human resources best practices.

Jennifer views clients as partners, and they rely on each other to achieve successful results. She knows her clients’ businesses. Jennifer is proactive: she remains well-informed on decisions, laws and recent developments and advises clients on critical and current issues affecting their businesses before litigation is necessary.

  • Achieved dismissal of lawsuit seeking $20+ million in damages from a client, a Japanese manufacturing corporation, by its United States exclusive distributor for a beauty industry product, and successfully re-negotiated the terms of a new distribution agreement.
  • Represented employer in appeal from a $28 million verdict entered against employer, including award of $23 million in punitive damages.  Successfully argued issues related to the finality of the judgment to the Court of Appeals and Supreme Court of Missouri, then successfully argued to the trial court to set aside the verdict and grant employer a new trial on all issues.
  • Acted as co-lead counsel on $100 million plus claims involving title insurance, real estate development, and landlord/tenant issues. Successfully negotiated global settlement of all claims, including the defense for client in numerous pieces of collateral litigation.
  • Handled multiyear litigation to successful conclusion with favorable verdict following seven day jury trial in a construction defect claim. Obtained judgment in separate declaratory judgment action holding insurers liable for construction negligence and violations of the Missouri Merchandising Practices Act.
  • Obtained a first-impression holding from the Iowa Court of Appeals, reversing the district trial court, that the Federal Arbitration Act preempts contrary Iowa state law regarding the enforceability of mandatory arbitration provisions of employment agreements where the subject agreement affects interstate commerce.
  • Successful appeal regarding title to real property valued at $100 million. 
  • Worked as part of appellate team to successfully gain transfer to the Missouri Supreme Court, which overturned the Court of Appeals, Southern District's opinion affirming the trial court's dismissal of a third party's claim for child custody. The case effectively established a third party's right to custody of a child in Missouri in certain circumstances.
  • Obtained defense verdict in federal jury trial concerning workplace battery alleged by former senior executive against peer senior executive of a software company.
  • Successful appeal from Labor and Industrial Commission entered order that denied claim for unemployment benefits. Appellate court affirmed the commission's denial of benefits.
  • Successful conclusion after jury trial defending individual on property damage claim.
  • Represented developer in multi-million dollar equitable mechanic's lien claim with numerous parties and claimants. Negotiated settlement of claims.
  • Represented higher education client in highly contentious multi-year litigation in wrongful discharge case. Secured a favorable settlement for client on the eve of trial.
  • Achieved summary judgment on bank's claims against debtor and guarantors in excess of $2 million.
