A litigator at heart, Meredith Duncan has the skills and experience to advocate for clients before government regulators, administrative law judges and courtrooms alike. She uses those skills to focus mainly on the compliance and operational issues facing health care providers, including long-term care providers, senior housing entities and hospitals. From licensing to contracts, to risk management and regulatory compliance, she responds to all issues that arise in all aspects of a health care provider’s practice.

Meredith also has significant experience assisting clients in their responses to reimbursement audits and appeals. She appears regularly before the regulatory agencies that oversee the health care industry, including the Centers for Medicare and Medicaid, the Office of the Inspector General, the Department of Healthcare and Family Services, the Illinois Department of Public Health, the Illinois Department of Professional and Financial Regulation, and other state and federal governmental agencies on behalf of clients.
  • Represented a licensed health care provider in a challenge to her professional license before the Illinois Department of Financial and Professional Regulation, which resulted in all allegations against the professional being dismissed.
  • Collaborated with a large hospital system to develop a process and issue-specific response templates for efficiently and effectively responding to and appealing Recovery Audit Contractor audits.
  • Successfully appealed Recovery Audit Contractor decision to deny coverage for inpatient hospital claims before Administrate Law Judge to obtain fully favorable decision for full coverage of the claim.
  • Represented a skilled nursing facility in a fraud claim against family that misrepresented resident assets and payor source to the facility's detriment. Resulted in a favorable settlement to the facility, including attorney’s fees.
  • Drafted successful arguments resulting in the deletion of federal certification deficiencies cited against a skilled nursing facility during an annual survey through the Informal Dispute Resolution process.
  • Successfully negotiated a favorable settlement with the Centers for Medicare & Medicaid Services and avoided termination on behalf of a laboratory alleged to have engaged in a proficiency testing referral in violation of Clinical Laboratory Improvement Amendments statute.
  • Represented a skilled nursing facility in involuntary transfer and discharge proceedings before the Illinois Department of Health where resident ceased paying for services.
  • Assisted a hospital with revisions to its Emergency Medical Treatment and Active Labor Act policy and its return to substantial compliance with Medicare conditions after the hospital was alleged to have committed a violation of EMTALA.
