Zuzana S. Ikels finds protecting and defending clients to be the most important and rewarding aspect of being an attorney. She devotes herself to learning the client's business and understanding and voicing the client's perspective. Drawing upon her experience litigating cases across a wide range of industries, she formulates and implements creative but pragmatic legal strategies and solutions. 

Her litigation practice focuses on handling complex commercial disputes, with particular emphasis in the healthcare, health tech and technology and telecommunications industries. She has successfully defended her clients against dozens of consumer class actions involving federal and state consumer-protection statutes and privacy laws, the False Claims Act, and other complex business disputes. Zuzana has an in-depth familiarity with IT and Big Data infrastructures, from advising on electronic records and retention programs, privacy and customer consent policies, devising strategic, e-discovery plans, database discovery and Big Data analytics. Through her in-depth knowledge of federal and state statutes and regulations governing privacy and security, the healthcare industry, and ecommerce, she devises creative and results-oriented legal strategies in high-stakes litigation. She has handled dozens of complex disputes and class actions involving federal and state competition, consumer-protection statutes and other privacy-related laws. She frequently counsels, presents on, and writes about privacy, interoperability, transparency, and consent, and other cutting edge laws and regulations, which effect the healthcare and Health Tech industry.
Healthcare Litigation
  • Obtained a dismissal of our hospital-client from a qui tam action in California state court. Relators, fifty-four insurance carriers, assert violations of California’s Insurance Fraud Prevention Act, the False Claims Act, and Unfair Competition Law (“UCL”) related to purported insurance billing fraud and counterfeit implants. A number of defendants were out-of-state individual and corporate defendants including our client.  Plaintiffs maintained that all of the defendants -- hospitals, surgeons, distributors, and sales representatives -- conspired together, despite their geographic and occupational diversity and the fact that many are direct competitors.  We filed a motion challenging the personal jurisdiction, which the Court granted and dismissed the hospital from the action.
  • Representing one of the largest, national providers of health care services against a novel, corporate negligence theory in medical malpractice case.
  • Representing a Southern California hospital in a qui tam action alleging insurance billing fraud, and related personal injury suits.
  • Obtained dismissal with prejudice of a physician's lawsuit regarding medical staff privileging decision.

Consumer Class Actions
  • Defeated class certification of putative national TCPA class action after two-day evidentiary hearing of experts. Warnick v. Dish Network LLC, 2014 U.S. Dist. LEXIS 87818 (D. Colo. June 27, 2014).
  • Responsible for defeating national and state consumer class actions asserting claims of various federal and state laws, including Sherman Act and state unfair business practices laws include California’s CLRA and 17200 actions, privacy and data protection laws, the Computer Fraud and Abuse Act, VPPA, the TCPA, and various states’ consumer protection laws.
  • Obtained dismissal, in matter of first impression, of all claims seeking monetary relief in a putative class action asserting violations of a data privacy federal statute.
  • Took over a nine year old case, defending the premier U.S. video satellite broadcaster against a nationwide class action of 20,000 outside salespersons asserting various tortious and contractual legal theories and seeking $1 billion in damages. Settled for a small fraction weeks before trial.

Technology and Intellectual Property Cases
  • Represented a cable and ISP provider in a class action regarding peer-to-peer file sharing applications and the FCC’s net neutrality doctrine. Won successive dismissals; settled with no monetary payment to the class.
  • Represented two internet companies against claims of patent and copyright infringement brought by Kazaa relating to anti-piracy software. Led to walk-away settlement.
  • Prosecuted hundreds of cases on behalf of the Recording Industry Association of America (“RIAA”) in the Northern California District Court against individual defendants accused of copyright infringement by illegally downloading music.
