Meet Your Polsinelli Shughart Speakers:

 

Andrew M. DeMarea has more than 15 years' experience representing general contractors, owners, designers and subcontractors in both the state and federal courts of Kansas and Missouri. He has represented these clients in all types of construction issues, including allegations of errors or defective construction, payment issues and liens, insurance and performance bond coverage, and personal injury defense.

Mr. DeMarea, a seasoned trial attorney, will discuss the ethical rules applicable to the negotiation of settlement agreements and other transactions, both in the context of litigated disputes as well as in the context of transactions where no active dispute is at issue. Particular fact scenarios will be discussed by Mr. DeMarea with real world examples.

Lisa A. Weixelman concentrates her practice in commercial litigation, insurance law and risk management. In the area of risk management, she assists clients in negotiating favorable terms for insurance and limiting liability exposure. As a trial attorney, she has served as lead counsel in jury and non-jury trials and has successfully negotiated settlements in numerous cases in state and federal court.

Ms. Weixelman will address the role of ethical rules in negotiations, and their focus on professionalism. She will also address the ethical rules impacting threats of prosecution and reporting misconduct of parties or counsel, and the ethical rules concerning negotiating when lawyers represent multiple clients.

Anthony J. Romano co-leads the firm’s nationally recognized Labor and Employment practice group. As defense counsel, Mr. Romano represents primarily corporate clients in disputes arising in labor and employment law, telecommunication law and general commercial litigation.

Mr. Romano, as both an advocate in mediations and as a mediator, will review the impact of ethical rules on the mediation process and in arbitrations. Within that scope, Mr. Romano will take a look at bluffing, puffing, and whether under ABA Formal Opinion 06-439 the presence of a judge or mediator changes what is permitted, and the ethics of negotiating in other jurisdictions.
