Six months into the IRS three-year audit initiative, it appears that this endeavor is designed to generate additional revenue for the government. Although the IRS Chief of Employment Taxes has said the desire is to make the audits "as least burdensome as possible," it is important to understand that the audit is not simply a review of the organizations' Form 941 for a given tax year (although that will be one aspect).
Mary K. Samsa and William P. Sweeney of Polsinelli Shughart’s Employee Benefits and Executive Compensation law group have analyzed the audit initiative and will share important implications for your organization in a complimentary ninety-minute webinar event on October 19.
The IRS is drilling down on the compensation that is generating withholding obligations and then further auditing those various compensatory components for reporting and tax compliance. Consequently, any benefits offered to an organization's employee population which are nontaxable are the focus of the audits and the IRS desires to ensure that those plans and policies are truly nontaxable. If not, then taxes can be collected.
Ms. Samsa and Mr. Sweeney will brief participants on:
- Executive compensation arrangements which the IRS is scrutinizing
- Fringe benefit arrangements which the IRS is auditing in-depth
- Backup withholding traps for organizations
- Employee/Independent contractor misclassification - the BIG ticket item
