A Polsinelli Shughart Update:

Where Did Health Care Reform Go?
 

In spite of media stories implying health reform law is well on its way to being “de-funded,” that is not the case. Congress is not repealing health reform legislation. A number of provisions and reductions of funding for programs are in store but the basic structure of the legislation will remain largely intact.

Although subject to considerable criticism for its implementation and enforcement of the “Patient Protection and Affordable Care Act” and the “Health Care and Education Reconciliation Act of 2010,” together known as the “Affordable Care Act” (ACA), the Administration continues to implement the statute at breakneck speed. The Department of Health and Human Services (HHS) produced several regulations and an array of guidances; provided technical assistance to various stakeholders; awarded grants and funded demonstration projects – all to implement the ACA. Parties affected by the ACA cannot afford to ignore the provisions of the law and the obligations that flow from it.

The primary vehicles for implementing health reform include:

  • The routine regulatory process for updating payment systems
  • Ongoing programs that predated the ACA, including programs implemented under the American Recovery and Reinvestment Act of 2009 (ARRA)
  • Rulemaking and guidance documents
