Top Issues Facing Health Care Providers |
BNA's Health Law Reporter Outlook 2010 Released |

Advisory board members of BNA's Health Law Reporter, including Polsinelli Shughart Shareholder Fred Entin, have released their annual outlook report, identifying the top 10 health law issues organizations should be aware of during the coming year, and commenting on what changes, if any, are likely to occur. While the recent Senate election in Massachusetts has created uncertainty about whether reform measures might be passed by Congress this year, health care reform continues to be a very important issue.
The top issues identified by the BNA advisory board that remain front and center for the health care industry include:

Health Care Reform – Since the President has not abandoned this as a top priority, some, if not all of the issues driven by reform may still emerge from Washington. |

Fraud and Abuse – The stakes are higher with an increased focus on enforcement and changes to the False Claims Act. |
3. |
|
Medicare – Payment programs based on performance rather than procedures will give rise to new relationships between and among providers. |
4. |
|
Quality – Can the alignment of physicians and hospitals occur without implicating the fraud and abuse laws? |
5. |
|
Antitrust –Will a more aggressive antitrust enforcement attitude create barriers to consolidation of providers? |
6. |
|
Health Information Technology – Will the HIT incentive program authorized by ARRA finally move providers to widespread adoption of technology, and how will such technology be acquired? |
7. |
|
Exempt Tax – Will a new standard replace the community benefit standard and will states continue to focus on exempt status? |
8. |
|
Health Plan Regulation – If there is any steam left in Washington to enact reform legislation, will they focus on the insurance industry and how? |
9. |
|
Medical Staff – Will various initiatives calling for closer alignment of physicians and hospitals result in more employed physicians and if so, what are the consequences? |

Labor and Employment – Shortages and consolidation may enable unions to mount successful organizing campaigns. |
