2009 Kansas Insurance Legislation

Faced with an incredible financial downturn, the Kansas Legislature saw 30 percent fewer bills introduced during the 2009 session. However, that did not preclude several insurance and administrative laws from being worked during the 2009 session.

2009 Missouri Insurance Legislation

A relatively light volume of insurance legislation was passed during the First Regular Session of the 95th Missouri General Assembly, which concluded on May 15, 2009. Two insurance bills supported by Governor Jay Nixon that did not pass the General Assembly would have extended healthcare coverage to more uninsured low-income individuals and would have mandated coverage for the treatment of autism.

Summary Orders in Kansas: The Legislative Response

In Polsinelli Shughart’s Winter 2008 Insurance Newsletter, we provided a discussion on the Kansas Insurance Department’s unique utilization of the summary orders authorized under the Kansas Administrative Procedures Act (KAPA). In that article, we posited that using summary orders against an insurance company, in essence, to settle consumer complaints was beyond the statutory authority of the Kansas Insurance Department.

The California Department of Managed Health Care (DMHC) recently announced that Association Health Care Management, Inc. d/b/a Family Care, headquartered in Houston, Texas, has become the first multiple-product medical discount plan to be licensed under California’s Knox-Keene Act.

Medicare Secondary Payer Reporting Requirements

   
The federal Medicare Secondary Payer laws generally state that the Medicare program does not have primary payment responsibility where private insurance and self-insurance programs provide coverage. Under the federal law, Medicare pays secondary to liability insurance, no-fault insurance, and workers’ compensation.
