These days, life at leading higher education institutions means, in addition to teaching students, multimillion dollar fundraising campaigns, high-profile coaching contracts and joint ventures with private businesses. Polsinelli Shughart lawyers Bruce R. Hopkins, Virginia C. Gross and Thomas J. Schenkelberg have just authored a book on the nonprofit law issues facing the nation’s higher learning institutions. The book, Nonprofit Law for Colleges and Universities, was released in August 2011, just as students began heading back to campus.
Colleges and universities are under the IRS microscope, according to Hopkins. He says the laws governing nonprofits are complex and ever-changing.
The book covers every "hot issue" in nonprofit law today directly affecting institutions of higher learning, both public and private. They include:
- Federal tax law rules concerning maintenance of tax exemption by private colleges and universities
- Role of the governing board of a college of university
- Executive compensation, scholarships and fellowships
- Legislative and political campaign activities
- How the business activities of a college or university impact tax-exempt status and raises unrelated business issues
