On March 25, 2014, the U.S. Environmental Protection Agency and U.S. Army Corps of Engineers jointly proposed a new rule to clarify the scope of waters subject to the Clean Water Act. The rule greatly expands the agencies' jurisdiction, particularly in the arid and semi-arid west [read more]. If the rule becomes final, real estate developments, mining facilities, forest and timber operations, renewable energy projects, and a wide variety of manufacturing sites may be subject to increased regulatory requirements governing waste discharges, storm water management, and spill prevention and control programs.
