On July 14, 2014, the Equal Employment Opportunity Commission (“EEOC”), by a 3-to-2 vote of commissioners, issued Enforcement Guidance on Pregnancy Discrimination and Related Issues (the “Guidance”), along with a question and answer document about the Guidance and a Fact Sheet for Small Businesses. The Guidance is the first attempt to provide a comprehensive update on the subject of pregnancy discrimination by the EEOC since 1983.

In the Guidance, the EEOC seeks to set forth employers’ obligations to pregnant employees under the Pregnancy Discrimination Act of 1978 (“PDA”) and discusses the EEOC’s current position with respect to the application of the Americans with Disabilities Act, as amended in 2008 (“ADA”), to individuals who have pregnancy-related disabilities.
