As one of the country’s largest pet product companies, Polsinelli's client had determined that it needed to get into the flea and tick pest control market. Pre-existing patents posed a challenge to market entry. Additionally, barriers to entry needed to be established to prevent knock-offs of newly created, successful products.
Polsinelli worked closely with marketing executives, senior management, and formulators to develop an integrated strategy. A four-year process of due diligence, patent drafting, trademark clearance, and product development resulted in successful market entry and product development, and ultimate acquisition of client at a significantly increased value.
After months of review and analysis, a strategy was developed which included:
- determining which patents related to flea and tick products would expire
- identifying which patents were invalid, and which patents would be circumvented
- conducting complex due diligence, creating a patent estate, and advising on packaging
A strategy was developed to patent particular products which would protect the unique pesticide product entry, and guidance was also provided on specific formulations for entry into the market.
