California has been at the forefront of educating the public to make informed decisions about various consumer products they use, foods and dietary supplements they ingest and business facilities where chemical exposures may occur. Proposition 65, enacted in 1986, is the first and most well-known law regarding warnings of various chemicals which cause cancer and birth defects. Other states are following suit, and the list of chemicals requiring warnings numbers in the thousands.
New warning regulations that may require specific identification of chemicals in certain products raises the bar for due diligence and stakes for potential liability. How can companies prepare for, and respond to, threats from private enforcer Consumer Advocacy Groups? What are the potential avenues for liability in an age where any company can sell products into California via direct online sales and third-party websites?
