Statistical Sampling and False Claims Act Liability: Aseracare
Health Care Fraud Institute | Thursday, December 7, 2017 | Atlanta
Polsinelli is proud to announce that Atlanta Office Managing Partner and Practice Chair Brian F. McEvoy
will present at the State Bar of Georgia's Health Care Fraud Institute held at the State Bar of Georgia Headquarters in Atlanta, Georgia. The one day conference features panels and discussions focused on Health Care Fraud, False Claims Act liability, Stark compliance, and analysis of relevant cases by experienced professionals.
For the last several years, False Claims Act litigation has been the primary civil enforcement tool used by the Department of Justice to fight fraud and recover significant damages and penalties. Statistical sampling and extrapolation have broadened the scope of claims and potential damages in these cases, giving the DOJ enormous leverage in pressuring defendants to settle cases. Aseracare and other recent cases are impacting the analysis of and strategies for FCA cases, including the issues of materiality of the alleged violation supporting falsity in mirror differences of expert opinions. This panel brings significant experience in subject matter expertise in the area of FCA litigation.
