Health Care Providers Prepare for the NLRB's Perfect Storm – Quickie Elections and Micro Bargaining Units
On April 14, 2015, the National Labor Relations Board ("NLRB") will be implementing a rule to dramatically speed up Union elections, reducing the waiting period between an election petition's filing and the vote itself (in many cases from 2-3 months to 2-3 weeks). If implemented, the "quickie election rule" (or "ambush election rule") will cause employers to lose most of their opportunity to educate themselves and their employees as to the effects of unionization. With high employee head counts across multiple shifts, medical providers could be among the organizations most impacted by this change.
Combined with the NLRB's recent policies and decisions which allow Unions to represent micro-bargaining units, at times consisting of a few employees on a given shift, it is more important than ever for health care providers to be prepared for possible Union organizing campaigns.
