Polsinelli Secures Federal Circuit Win for Power2B in Samsung Patent Challenge
Polsinelli is pleased to announce a significant win for firm client Power2B, as the U.S. Court of Appeals for the Federal Circuit affirmed the Patent Trial and Appeal Board’s findings in two inter partes review proceedings brought by Samsung Electronics.
Before the Patent Trial and Appeal Board, Polsinelli successfully argued Samsung failed to show the challenged claims were unpatentable because, in part, Samsung forfeited a key argument that Samsung attempted to introduce in its reply briefing. On appeal, the Federal Circuit upheld the Board’s findings and found the Board did not abuse its discretion when it rejected Samsung’s new invalidity argument. The ruling marks a significant victory for Power2B and preserves its patent rights covering technology for navigating and controlling handheld electronic devices.
This decision follows earlier Federal Circuit activity involving other Power2B patents and marks another important outcome for the company in its ongoing defense of its intellectual property.
