Polsinelli Represents Mo Honarkar/4G Wireless in Dismissal of Bankruptcy Cases

Polsinelli recently represented Mohammad Honarkar and 4G Wireless in the bankruptcy cases of MOM CA Investco and its affiliates. The cases involved a significant real estate portfolio across Southern California and Laguna Beach valued at over $400 million that Honarkar contributed to a joint venture with Continuum Analytics and its principal, Mahender Makhijani.

The joint venture entities, including 19 subsidiaries that owned the properties, filed for bankruptcy shortly after an arbitrator found that Continuum and Makhijani had fraudulently induced Honarkar and 4G to enter the partnership, as well as conversion and other findings.

The Polsinelli team challenged every aspect of the Chapter 11 bankruptcy, including objecting to the filings and proposed sales, seeking the appointment of a Chapter 11 trustee and ultimately moving to dismiss. After months of extensive litigation, the bankruptcy court granted the dismissal, allowing Honarkar and 4G to return to California state court to pursue damages under the arbitration award, which was the client’s ultimate goal.
