Am Law 100 Polsinelli is pleased to announce that Fabio Marino, Vice Chair of the Intellectual Property Department, Chair of the IP & Technology Litigation Practice Group and Northern California Managing Partner, has been recognized by the Daily Journal as a 2019 Top Intellectual Property Lawyer. The list honors the 75 California lawyers who had the biggest impact in the area of Intellectual Property law in 2019.

Marino heads Polsinelli’s Intellectual Property Litigation practice as a first chair for networking, software and hardware companies. One of the highlights of his Daily Journal profile was his work preparing for a major patent infringement trial before U.S. District Judge Susan Y. Illston of San Francisco. 

“At this point, trial prep is the majority of my team’s work,” Marino said. “We’re in expert discovery, prepping witnesses and analyzing issues. Then, we try to synthesize issues to their core elements to be presented to the jury. The art of getting ready for trial includes trying to tell a story about people — in this case, for our main inventor, we try to tell why what he did was better than what came before.”

“A lot of our preparation is designed to counter what the other side will have to say,” Marino noted. “We do a lot of work to try to anticipate the other side. It’s the creative part of the job, and I take that role, putting myself in their shoes and letting my team figure out our response.”

Marino is a well-known IP trial lawyer with more than two decades experience. Chambers USA calls him “one of the go-to names in the business” who is admired for “his courtroom presence and impressive skills as a patent litigator.” He tries high-stakes intellectual property cases across the country, with an emphasis on computer-related technologies.

He has experience in a variety of technology areas including computer networks, telecommunications, software engineering, computer architecture, 3D graphics and animation, medical imaging and artificial intelligence, to name a few. Marino handles complex litigation matters such as patent infringement, trade secrets misappropriation, copyright theft, breach of contract and trademark infringement both at the trial level and on appeal.
