Who's the Boss?
Courts and administrative agencies have responded to changes in businesses’ organizational and staffing models by expanding the definition of “joint employers,” a finding that an employee has more than one employer – each of whom may be jointly and severally liable for regulatory compliance. Recent administrative guidance and rulings show that courts and administrative agencies should not be expected to adopt the status employers affix to their own workers. A finding of joint employment also complicates the already perilous interplay between the ADA, FMLA, OSHA, and Workers’ Compensation laws.
This roundtable is intended to be an interactive discussion focused on the factors considered in determining whether joint employment exists, and real world experiences navigating an employer’s obligations under the ADA, FMLA, OSHA, and Workers’ Compensation laws.
