Workplace Investigations: The Good, the Bad, and the (Sometimes ... ) Outright Fraudulent

HR professionals know how critical workplace investigations can be in today's litigation climate. Prompt, remedial investigations are legally required for any number of workplace complaints, and an investigation needs to produce a real remedy if there is a real complaint. Workplace investigations often take center stage – not only for the already-busy HR professional – but also as key evidence in litigation. New Missouri law on fraudulent, or bad-faith, investigations will cause administrative agencies, juries, and judges to take an even more focused look at how workplace investigations are conducted. HR professionals may need to take a new look at whether an in-house or an outside investigation is the optimal use of time, money, and resources.
