The United States Supreme Court issued a decision in the “Gas Cases,” ONEOK v. Learjet. The Polsinelli firm represents commercial and industrial purchasers of natural gas in their antitrust claims against ten natural gas companies. In a 7-2 decision, the Court affirmed the Ninth Circuit holding that our clients’ claims were not preempted by the Natural Gas Act. This ruling preserves the essential dual-regulatory character of the Natural Gas Act, affirms States’ rights, and will allow us to take our clients’ claims to trial.
