The TCPA: Dial In For Compliance in 2015
While the Telephone Consumer Protection Act (TCPA) has been in force since 1991, the evolution of its application has resulted in potentially crushing financial consequences for corporations – sometimes catching them completely off-guard. Major global corporations have entered into multi-million dollar settlements to resolve TCPA class actions, but running afoul of the TCPA can also have significant implications for smaller businesses across a variety of industries.
What should general counsel and other stakeholders know about the TCPA, and what proactive steps can they take to mitigate their risk of litigation? Polsinelli Principal Richard Giller from the firm's Insurance Recovery practice and Shareholder Russ Jones and Associate Robert Spake from Commercial Litigation will examine the TCPA's impact on different layers of your business and recommend best practices for 2015 and beyond.
Topics of discussion included:
- A brief overview of the TCPA, focusing on emerging trends in litigation
- The financial risk of TCPA non-compliance – liability is real, and must be taken seriously
- Open legal questions for the TCPA, including what constitutes an automatic telephone dialing system, how fault is determined in recovery under insurance policies, the various theories of vicarious liability and how potential class action liability is assessed and addressed
- What the future may hold for TCPA regulatory activities, and proactive steps companies can take to mitigate financial risk
