With an eye toward being a valued resource and partner to clients, Anne Cherry Barnett approaches each matter with the goal of streamlining costly litigation and achieving the client’s objectives successfully and efficiently. Anne focuses her practice on employment matters and has represented clients of all sizes, including start-ups and large Fortune 50 companies. She prides herself on providing sound and cutting edge legal strategies that consistently focus on the client’s bottom line as they navigate the complex labyrinth of California and Federal employment regulations. Anne has represented employers in single plaintiff and class action litigation and her areas of focus include:

Anne also regularly counsels employers regarding compliance with wage and hour laws, exempt and non-exempt classification, independent contractor status, founder disputes, workforce reductions, discrimination claims, workplace investigations, employment policies and risk management regarding potential litigation. She is able to develop scalable employment policies for young companies to create consistent handling of employment matters and claims to maximize efficiency and reduce use of employer resources.     
 
Anne has a proven track record of successfully defending corporations and individuals in the Western United States and various Federal Courts in high value litigation. She is also an experienced litigator in the areas of products liability, commercial litigation and catastrophic personal injury matters and served as co-trial counsel during a successful defense verdict for a chemical manufacturer where the Plaintiff sought over $100 million in damages. 

  • Successfully defended California retailer in cutting edge wage and hour class action litigating newly enacted Labor Code 226.2 (Piece Rate)
  • Prevailed on Motion to Dismiss for California retailer in a wage and hour class action at outset of litigation. 
  • Successfully defended security company in California class action litigation alleging various California Labor Code violations.
  • Counseled start-up company on handling of founder dispute. 
  • Favorably resolved age discrimination action on behalf of technology company.
  • Obtained dismissal of a wage and hour claim before discovery.
  • Served as California employment counsel advising technology company on employment law compliance.  
  • Served as California employment counsel advising product manufacturer on employment law compliance issues. 
  • Represent agriculture company in various discrimination, harassment and misclassification claims. 
  • Successfully defended employers in single-plaintiff and class-action cases, including wage and hour class-action.
  • Co-trial counsel in successful defense verdict on behalf of Fortune 50 chemical manufacturer in products liability action where Plaintiff sought over $100 million in damages.
  • Member of trial team that obtained a unanimous defense verdict in favor of securities broker-dealer and clearinghouse.
  • Obtained favorable resolution due to key motion practice for Fortune 50 heavy equipment manufacturer in roll-over lawsuit brought by minor plaintiffs. 
  • Trial team member for Fortune 50 heavy equipment manufacturer in products liability lawsuit resulting in defense verdict. 
  • Served as Regional Counsel for Fortune 50 heavy equipment manufacturer managing products liability litigation in the Western United States. 
  • Favorable resolution of multi-million dollar catastrophic personal injury action as a result of successful motion practice limiting minor plaintiff’s claims.
