With an emphasis on commercial litigation and insurance coverage matters, Cary Hall thrives on managing complex litigation. Cary serves as the Litigation Department Business Division Co-Chair as well as the Commercial Litigation Practice Co-Chair. Cary also represents manufacturers in cases involving failure to warn or maintain, design defect, and manufacturing defect claims.  

His insurance coverage practice involves counseling and litigation on behalf of corporate policyholders with respect to: 
  • Designing insurance coverage strategies  
  • Conducting policy review  
  • Advising on policy implications resulting from lawsuits and claims  
  • Breach of contract  
  • Bad faith litigation
Cary was elected as a Fellow in the American College of Coverage and Extra Contractual Counsel, an organization which admits less than 1% of the lawyers in the United States. He is also a sustaining member of the Product Liability Advisory Council (PLAC). Additionally, Cary serves as Chair of the Phoenix office Recruiting Committee.
  • Ongoing representation of international silicon wafer chip manufacturer as lead trial counsel in lawsuit seeking more than $3 million in property damage against a former vendor.
  • Obtained $32 million judgment on behalf of telecommunications company in breach of contract and business tort litigation.
  • Ongoing representation of Italian gas valve manufacturer in lawsuit brought by severely burned plaintiffs alleging product defect caused an explosion in their mobile home.
  • Won a defense verdict as lead trial counsel in an October 2018 2-week jury trial in California where the plaintiff sought $17 million for a traumatic brain injury against a Fortune 500 moving and transportation company.
  • Successful defense of multiple TCPA lawsuits brought in California and Arizona against national credit card issuer.
  • Ongoing representation of national blood product supplier as national coordinating counsel and lead trial counsel in lawsuits involving product liability and breach of contract claims.
  • Representation of recreational products manufacturer in lawsuit alleging toxic exposure to Beryllium.
  • Successfully argued to exclude a plaintiff's expert from testifying in a lawsuit in which the plaintiff sought $50 million in damages for an alleged traumatic brain injury. Served as lead trial counsel in a two-week jury trial, and secured a non-suit based on plaintiffs' failure to prove its case in chief.
  • Ongoing representation of Fortune 500 transportation and moving company as lead trial counsel in personal injury lawsuits covering seven states.
  • Obtained summary judgement for hospital in toxic exposure lawsuit brought by former employees of an independent contractor.
  • Obtained summary judgment against 110 plaintiffs seeking more than $10 million, alleging mold exposure in their apartment complex.
  • Obtained a $2.3 million default judgment against an emissions testing provider and an assignment of rights to pursue against its insurance carriers.
  • Investigated employee theft allegations against a former employee. Obtained a recorded confession from the employee and full restitution of more than $100,000.
  • Successful prosecution of insurance coverage against insurers of the World Trade Center after the 2001 terrorist attacks. Action was on behalf of the main lender to World Trade Center investor, obtaining more than $500 million.
  • Obtained successful settlement for an international manufacturer of power tools and equipment after limited discovery demonstrated improper use of the power equipment.
  • Ongoing litigation involving prosecution of insurance coverage for directors and officers malfeasance.
  • Successful representation of a pharmaceutical company in the prosecution and appeal of claims seeking insurance coverage for mass tort claims arising out of alleged HIV- and HCV-tainted blood products. Obtained more than $250 million in insurance coverage.
  • Obtained summary judgment in personal injury case against biopharmaceutical company based on a patient's informed consent to participate in clinical trials of investigational drugs. Served as national coordinating counsel of more than a dozen such suits.
  • Obtained summary judgement for self-insured Fortune 500 company in lawsuit seeking $5 million in damages for alleged breach of contract and breach of good faith and fair dealing.
  • Obtained $8 million+ settlement for blood products manufacturer in claim against vendor for breach of contract.
