Daniel focuses his practice on helping lenders maximize their existing investments. He represents financial services companies, loan servicers, banks and other lenders in the enforcement of their loan documents, whether through workouts or litigation. His experience spans both securitized loans and loans held on his clients’ balance sheets. In addition to enforcing lender’s rights in their relationships with borrowers, Daniel focuses on disputes between lenders in multi-lender transactions and securitized loan repurchase disputes. He has extensive experience representing loan servicers, trustees of securitized commercial loan pools, national and regional banks, commercial real estate finance organizations and private equity funds that invest in real estate loans and other debt instruments. Daniel also has extensive experience representing lender’s rights in bankruptcy proceedings, and his workout experience includes representing both buyers and sellers of loans. Daniel’s experience has given him the perspective to enforce and restructure loans not only to resolve current disputes, but also to avoid future complications.

In addition to his work for financial services companies, Daniel previously represented a variety of businesses in both state and federal courts in commercial litigation, including contract disputes, financial fraud and civil RICO matters, and  bankruptcy litigation. He represents clients ranging from small family-owned businesses to multi-national holding companies.

Daniel regularly appears in federal and state courts across the nation at trials and hearings and represents clients at arbitrations and mediations. He also has substantial experience:

  • Presenting and arguing dispositive motions.
  • Facilitating both traditional and electronic discovery.
  • Advising clients regarding statutory compliance.
  • Counseling clients regarding a wide variety of contracts, including, purchase and sale agreements, limited liability company agreements, shareholder agreements and licensing agreements.
