Jason is a partner in the firm’s Financial and Securities Litigation and Commercial Litigation practice groups. He has extensive litigation experience, including numerous first-chair jury trials, trials to the court, and arbitrations. He prides himself not only on being an excellent trial lawyer, but also on having a practical understanding of his clients' business needs. This understanding began with his business and finance degree and has grown with nearly two decades of partnering with businesses, large and small, to understand their needs and help them reach their goals.  
He has experience in:
  • Complex litigation, including breach of contract, shareholder disputes, fraud, unfair competition, and other business torts
  • Intellectual property litigation, including trade secrets, non-compete and non-solicitation agreements
  • Bankruptcy-related litigation, including adversary proceedings for fraudulent transfers and preferences
  • Estate, trust and fiduciary litigation
  • Real estate litigation, including condemnation/eminent domain proceedings
  • Alternative dispute resolution, including numerous mediations and arbitrations
  • After obtaining favorable preliminary injunction, obtained multi-million dollar jury verdict in favor of client in suit alleging misappropriation of trade secrets, breach of duty of loyalty, breach of fiduciary duty, and other claims.
  • Defended finance company in suit alleging nearly $40 million in damages arising from alleged fraudulent transfers and preferences filed by chapter 7 bankruptcy trustee in bankruptcy court.
  • Served as nation-wide monitoring counsel for Fortune 500 company.
  • Filed and litigated fraudulent transfer suit on behalf of chapter 7 bankruptcy trustee in California bankruptcy court.  Suit involved claims to avoid fraudulent transfers including collusive non-judicial foreclosure of real estate, and negation of good faith and value defenses under the Bankruptcy Code.  Obtained favorable resolution of the claim after lengthy mediation.
  • Filed, litigated and successfully resolved suit for breach of non-compete agreement.
  • In the defense of a Fortune 500 manufacturing company, undertook extensive informal investigation and narrowly tailored discovery to develop facts and obtain early dismissal of all claims against client, resulting in significant cost savings.
  • Represented national hospital organization in suit challenging enforceability of deed use restrictions.
  • After a nearly two-week jury trial, obtained favorable verdict in a case where the plaintiff had suffered catastrophic injuries and sought millions in damages.
  • After commissioners' hearing and extensive briefing on key valuation issue in condemnation case, obtained favorable award and settlement approximately seven times the initial amount offered by the condemning authority.
  • Defended large law firm and several of its attorneys in a multi-million dollar professional liability suit. Obtained favorable ruling from the Kansas Supreme Court on a certified question of law, resulting in dismissal of claims against clients without any monetary payment.
  • Represented client in "business divorce" of family-owned company involving valuation of income-producing property. Utilized high-low parameters in conjunction with independent valuation, resulting in prompt and favorable resolution and significant cost savings for client.
  • Defended co-owner of business in suit alleging breach of contract, fraud, and other misconduct. Prosecuted various counterclaims using targeted discovery to strengthen the counterclaims and leverage, resulting in favorable resolution.
  • Obtained favorable arbitration award in breach of contract action. Aggressively pursued claims for fraudulent transfers and piercing the corporate veil to obtain favorable settlement against LLC's sole member and new companies that received fraudulent transfers.
  • Represented natural gas pipeline company to negotiate and obtain right-of-way for new pipeline. Minimized number of litigated right-of-way acquisitions, and obtained favorable settlements in those that required litigation.
