Leane K. Capps enjoys effectively solving companies’ legal problems while ensuring clients’ legal outcomes align with their culture and business objectives. Leane K. Capps has extensive litigation and trial experience in a wide variety of matters including class actions, multidistrict litigation (MDL), contractual disputes, business dissolutions, breach of fiduciary duty claims, directors' and officer's liability, and indemnity claims. Leane has extensive experience in a variety of industries including aviation, sports and entertainment, technology, and oil and gas. She has been named in the Best Lawyers of America and Texas Super Lawyers for commercial litigation and appeals, and has been named as one of the Top 50 Women Attorneys in Texas and one of the Top 100 Texas Super Lawyers. She is a Senior Fellow in The Litigation Counsel of America TM, a peer-selected, national honorary society of trial lawyers. She is Board Certified in Civil Appellate Law by the Texas Board of Legal Specialization. She is also a Panelist on the American Arbitration Association National Roster of Arbitrators.
  • Lead trial counsel for collegiate conferences in antitrust class action involving benefits to student athletes. 
  • Lead trial counsel for collegiate conferences in multidistrict litigation seeking putative class action related to football concussions.
  • Successfully represented sports media rights holder as lead counsel in six day arbitration against broadcaster regarding contract dispute.
  • Successfully reversed on appeal a million dollar judgment for breach of an installment agreement based on evidentiary errors committed by the trial court resulting in a new trial.
  • Successfully defeated a summary judgment motion filed by a beneficiary of a guaranty against the guarantor by creating a fact issue regarding whether the debt was actually owed.
  • Successfully defended collegiate conference in class action brought by former student athletes seeking damages for the use of their name, image and likeness. The claims were dismissed and the dismissal was upheld on appeal.
  • Successfully represented companies as lead counsel before the United States Court of Appeals for the Fifth Circuit resulting reversal of trial court's decision that the companies should not be allowed to amend their claims.
  • Successfully represented airline in case brought by passenger claiming significant damages allegedly sustained during flight. 
  • Successfully obtained summary judgment on working interest owners right to keep interests after operator filed for bankruptcy, which triggered a preferential right to purchase provision right of a Fortune 500 company.
  • Successfully defended global security company sued in lawsuit arising out of the acquisition of a competing company for patent infringement, resulting in determination that patent was invalid.
  • Successfully defended prior owner of oil and gas company that started a competing business after execution of non-compete.
  • Successfully defended putative class action as lead counsel claiming overtime wages were owed, resulting in complete dismissal.
  • Obtained a binding declaratory judgment for a business owner that an indemnity agreement was unenforceable as a matter of law in largest national recall of aviation parts in the United States, relieving the business owner of over $500 million in indemnity claims.
