Leane K. Capps enjoys effectively solving companies’ legal problems while ensuring clients’ legal outcomes align with their culture and business objectives. Not only does Leane have extensive courtroom, litigation, arbitration and appellate experience, clients also turn to her for advice in order to avoid litigation or quickly resolves disputes in order to avoid litigation. 

Leane K. Capps has over twenty-five years of experience. She has served as defense counsel in numerous class actions and multidistrict litigation across the nation. She also represents business clients in matters involving contractual disputes, business dissolutions, breach of fiduciary duty claims, indemnity claims and claims arising from asset and stock purchase agreements. Leane is known for her representation of clients in the sports and aviation industries. Leane is an integral member of the Sports Industry Group and a Practice Leader of the Aviation Group. Leane sits on the Advisory Board of the non-profit group Dallas Influencers in Sports and Entertainment.

Leane is listed in the Best Lawyers of America and Texas Super Lawyers for commercial litigation and appeals and has been named as one of the Top 50 Women Attorneys in Texas. She is a Senior Fellow in The Litigation Counsel of America TM, a peer-selected society of trial lawyers. She is Board Certified in Civil Appellate Law by the Texas Board of Legal Specialization, a distinction that is held by just over four hundred attorneys in the State of Texas. Leane is also arbitrator and is a Panelist on the American Arbitration Association’s National Roster of Arbitrators.

  • Lead counsel for aviation company in arbitration against service provider for breach of contract and determination that non-compete was unenforceable. 
  • Lead appellate counsel for party enforcing restrictive covenants judgment. Successfully affirmed judgement enforcing covenants and award of attorneys' fees. 
  • Lead trial counsel for national distributor of products in successful motion to dismiss for want of personal jurisdiction. 
  • Lead trial counsel representing communications company in successful motion to enforce arbitration provision. 
  • Lead appellate counsel for collegiate athletic conference. Successfully obtained writ of mandamus in plea in abatement proceeding, effectively terminating litigation.

  • Successfully defeated a summary judgment motion filed by a beneficiary of a guaranty against the guarantor by creating a fact issue regarding whether the debt was actually owed.
  • Lead trial and appellate counsel for collegiate conference in class action brought by former student athletes seeking damages for the use of their name, image and likeness, claims were dismissed and upheld on appeal. 
  • Lead appellate counsel obtaining reversal of district court's decision denying leave to amend. 
  • Successfully represented airline in case brought by passenger claiming significant damages allegedly sustained during flight. 
  • Successfully obtained summary judgment on working interest owners right to keep interests after operator filed for bankruptcy, which triggered a preferential right to purchase provision right of a Fortune 500 company.
  • Successfully defended global security company sued in lawsuit arising out of the acquisition of a competing company for patent infringement, resulting in determination that patent was invalid.
  • Successfully defended prior owner of oil and gas company that started a competing business after execution of non-compete.
  • Successfully defended putative class action as lead counsel claiming overtime wages were owed, resulting in complete dismissal.
  • Successfully obtained a binding declaratory judgment for a business owner that an indemnity agreement was unenforceable in national product recall eliminating over $500 million in indemnity claims.
