Libby Marden is a proven litigator with strong advocacy skills, strategic and analytical abilities, and business acumen that make her a valuable asset to the firm’s litigation team. Libby is dedicated to developing outcome-driven litigation strategies that are aligned with her clients’ business goals. She takes pride in partnering with clients to achieve positive outcomes both inside and outside of the courtroom.

Libby’s practice focuses on complex commercial litigation involving breaches of contract, business torts, and class actions for telecommunications, sports, healthcare, and technology companies. She has successfully represented clients in numerous multimillion-dollar business disputes as first-chair and second-chair trial counsel. Libby also assists clients in developing litigation avoidance and risk management strategies tailored to their specific business needs.

Libby’s experience includes serving as trial counsel in the successful defense of multiple “bet-the-company” litigations with hundreds of millions of dollars in potential exposure. She has also obtained numerous complete victories for both local and national organizations in the prosecution and defense of licensing and contract disputes. Libby has successfully defended companies charged with data breach, privacy, TCPA, RICO, and other class actions. She has also developed, implemented, and managed programs for the successful and cost-efficient defense of high-volume litigation and arbitrations for numerous consumer-facing clients.

Prior to joining Polsinelli, Libby earned her J.D. from Columbia University, where she was named a James Kent Scholar and Tony Patiño Fellow and won two Richard R. Baxter Awards for her team’s world championship-winning memorials at the Philip C. Jessup International Moot Court competition.
  • Served as trial counsel in successful defense of a $500 million action for breach of contract and misappropriation of trade secrets on behalf of an international telecommunications company.
  • Served as first-chair trial counsel in successful defense of numerous multimillion-dollar breach of contract and tort disputes nationwide on behalf of major wireless carrier.
  • Developed innovative case and document management systems and analytical reporting mechanisms on behalf of numerous large consumer-facing clients for the successful and cost-efficient defense of high-volume litigation and arbitrations.
  • Authored successful dispositive motions and obtained complete victory on behalf of multiple Fortune 500 companies in data breach and privacy class actions. 
  • Served as first-chair trial counsel in successful prosecution of numerous licensing and contract disputes on behalf of major sports organization, obtaining millions of dollars in judgments for the client. 
  • Authored successful dispositive motion and managed complex discovery on behalf of one of the U.S.’s largest healthcare systems in successful prosecution of $200 million breach of contract dispute.
  • Secured dismissal of multimillion-dollar case involving claims of fraudulent concealment and breach of fiduciary duty for Fortune 100 corporation in federal appellate court.
  • Served as trial counsel in successful defense of TCPA class action on behalf of telecommunications and technology company.
  • Managed complex discovery and authored successful dispositive motions in prosecution of breach of fiduciary duty claims on behalf of a bankruptcy trustee in federal district court, obtaining more than $100 million for the client. 
  • Successfully obtained numerous monetary judgments and injunctive relief orders on behalf of major hospitals and healthcare systems in lawsuits against federal and state agencies. 
  • Obtained complete victory on behalf of organization in multimillion-dollar tax appeal before a state tax commission.
  • Successfully defended commercial real estate company in multimillion-dollar RICO class action. 
  • Secured dismissal of multimillion-dollar patent and trademark case in federal district court.  
  • Served as trial counsel and managed complex discovery in successful prosecution of antitrust and patent claims on behalf of major international technology company.  
  • Managed complex discovery and trial preparation activities in successful defense of major national hospital chain in highly publicized antitrust lawsuit brought by a state attorney general.
  • Successfully defended multiple billion-dollar companies in class actions for alleged state statutory violations.
