Matt Moriarity handles matters across the financial spectrum – ranging from a few thousand dollars to those in the hundreds of millions of dollars – from protecting the rights of creditors and debtors in state, federal, and bankruptcy courts across the nation to representing businesses and developers in a broad range of real estate and contractual matters.  Matt has extensive experience representing clients in all aspects of real estate and financial litigation, including:

  • Mortgage foreclosure actions and trustees’ sales;
  • Receivership actions and sales, tenant disputes;
  • Workouts and restructures;
  • Deed transfers in lieu of foreclosure, discounted payoff agreements, forbearance agreements, modifications, assumptions, short sales, and Uniform Commercial Code Article 9 sales;
  • Lender liability claims;
  • Contested bankruptcy actions, including stay relief, confirmation, fraudulent transfers, and other bankruptcy litigation;
  • Contact disputes and litigation; and
  • Real estate transactions, finance, and development – from property purchases and sales, to obtaining economic development incentives in connection with property development.

Matt also handles the negotiation and drafting of complex loan documentation, as well as general real estate, business and commercial law matters. In addition, Matt has extensive deposition and courtroom experience, and has successfully represented clients in trial proceedings, mediations, and arbitrations.
