Mr. Hohenstein is a member of the Real Estate and Financial Services Department. He emphasizes construction law, insurance coverage matters and real estate in his practice.

With respect to construction, Mr. Hohenstein has extensive experience handling construction litigation disputes in state and federal courts and in arbitration proceedings. He also devotes a considerable portion of his practice assisting clients in the review, drafting and negotiation of construction contracts and related agreements. In the course of his construction-related practice, he has represented general contractors and construction managers, subcontractors and material suppliers, architects and engineers, landlords and other owners and developers, and surety companies. The cases in which he has participated have included numerous contract disputes and mechanics’ lien claims.

Mr. Hohenstein also has experience with environmental, product liability and construction coverage issues, as well as general commercial litigation, with emphasis on real estate and landlord tenant and sales disputes.

  • Representing owners, contractors, and design professionals in complex contract drafting and negotiations.
  • Resolving disputes through negotiation, litigation, and arbitration.
  • Defended to judgment owner/developer of a sports complex on a claim brought by general contractor for additional work.
  • Represented general contractor on an interstate highway project in an arbitration claim brought by the subcontractor for payment and for delay damages.
  • Represented several large general contractors in claims brought by subcontractors for payment.
  • Provided advice leading to resolution of multiple disputes involving defective or delayed construction and the prosecution and defense of mechanic’s liens.
  • Represented a large general contractor in drafting and negotiating more than 50 general contracts, construction management agreements, and related documents, including contracts for the construction of an international headquarters of a major credit card company, a city convention hall, convention hotels, and regional hospitals.
  • Represented a regional architectural firm in drafting and negotiating contracts with institutional owners.
  • Proficient in the use and modification of standard industry contract forms.
  • Provided counsel to contractors, other businesses and individuals on a variety of insurance coverage matters.
  • Represented insureds in insurance coverage lawsuits.
