Wesley D. Hurst is a principal in our Los Angeles office and a member of the firm's Litigation Department. Mr. Hurst has a highly successful record in all aspects of business litigation, including construction, real estate, financial services and contract disputes. Mr. Hurst also defends consumer product and class actions.

Mr. Hurst leads a nationwide Mobility and Vehicle Use Practice. He represents rental car companies, car sharing companies, vehicle subscription platforms and automobile manufacturers and companies pursuing new and emerging business models related to mobility and the use of vehicles. Mr. Hurst is a frequent speaker and author on mobility related topics.

Mobility & Vehicle Use Projects

  • Assisted with the launch of a free floating car share platform. 
  • Assisted with the launch of a number of vehicle subscription platforms.
  • Updated and revised courtesy and rental car agreements for every state in the country.
  • Assisted with the launch of a multi-purpose vehicle use platform.
  • Assisted with the launch of a number of rental car operations.
  • Reviewed the operations and processes for a number of vehicle use platforms and assisted with risk mitigation and revisions and updates to contract terms.
  • Reviewed and provided advice on insurance issues for a number of vehicle use platforms.
  • Provided advice for autonomous vehicle operation.
  • Reviewed and updated the contract terms for a micro-mobility company.

Litigation Matters

  • Represented a national rental car company in defending against multiple representative and class actions alleging violations of various consumer statutes.
  • Represented a retailer in a class action in California alleging a violation of a consumer protection statute in connection with the sale of automotive products.
  • Represented owner in a dispute with contractor and subcontractors arising from the construction of commercial buildings used for biotech in South San Francisco.
  • Represented a lender in an appeal arising from a loan agreement and personal guaranty enforcement action.  
  • Represented a national rental car company in the defense of various tort claims, including negligent entrustment.
  • Represented a solar contractor in a dispute regarding scope and timing of a project.
  • Represented a general contractor in a dispute with a demolition subcontractor. 
  • Represented national general contracting firm in litigation arising from the design and construction of a $500 million silicon chip manufacturing plant in Colorado.
  • Represented institutional investor in numerous cases, including class actions, arising from the construction and sale of thousands of single family homes in residential projects throughout California.
  • Represented a financial institution in managing numerous actions, including loan enforcement and real estate liability matters. 
  • Represented a manufacturer of personal computers in defending a consumer class action challenging the company's internet sales practices. 
  • Represented an individual in a dispute regarding the control and sale of a business. 
  • Represented a national clothing chain in defending a consumer class action challenging the company's internet sales practices. 
  • Represented a developer in a dispute with a joint venture partner regarding the development of a golf course in Southern California.
  • Represented a national consulting firm in the enforcement of guaranty obligations. 
  • Represented a purchaser of real estate in a failure to disclose case against a seller.
  • Represented a national retailer in lease litigation filed across the country. 
  • Represented a medical provider in disputes regarding medical services and pricing. 
  • Represented equity investor in litigation and bankruptcy proceedings arising from investments in dairies. 
  • Represented a group of investors in a telecommunications company in litigation and bankruptcy proceedings. 
  • Represented contractor in dispute arising from the construction of a $5 million residence in Marin County, California. 
  • Represented residential owner in dispute arising from the construction of an $8 million residence in Woodside, California.
