This session covered various conditions a landlord must meet to achieve “delivery of possession.” Topics included a fact pattern that addressed what it means to deliver possession and what happens when the parties cannot agree whether “possession” has, in fact, been delivered. These issues were viewed from both transactional and litigation lenses.
