Polsinelli’s Intellectual Property Department has significant end-to-end experience in the chemical industry, spanning from patent prosecution to intellectual property litigation. Our attorneys work on matters related to both inorganic and organic chemistry, and applications ranging from benchtop to industrial-scale manufacturing. Our team has worked on process design associated with refining and manufacturing plants, down-hole chemistry and pharmaceuticals. Additionally, we have worked in the food chemistry area.

With more than 90 technical degrees across the IP Department, including those related to chemical engineering, biochemistry, pharmacology and geochemistry, our deep team has honed their abilities to work in a various chemical areas and protect clients with patent estates both large and small. We offer patent prosecution, freedom-to-operate opinions, searching and clearance and intellectual property litigation, including enforcement and defense. Within the last six months, we have obtained patents for our clients in diverse areas including organic chemistry, pharmaceuticals, polymer chemistry, materials sciences, chemistry pertaining to oil, gas and petroleum refinery, food sciences, nutraceuticals, cosmetics, vaccines, biochemistry, genetics (e.g., miRNA) and biological diagnostics.

While we assist chemical clients of all sizes, a particular strength of the practice is significant experience managing major estates of over 1,000 patents, and prosecuting those applications all across the U.S. and internationally.

  • Built a robust patent estate to support a drug that helps neonates and infants with amino acid deficiencies. The patent estate was issued at remarkable speed (within approximately 12 months), which the client was able to sell shortly afterward for $42 million.
