Client Counseling, Leadership & Litigation Strategy

Allegra works closely with clients and experts to assess legal and factual issues and scientific, technical and industry-specific issues and she formulates case strategy and manages litigation planning from inception through resolution across multiple jurisdictions. Her work includes:

• Advising clients on litigation strategy, risk assessment, settlement and business objectives and giving formal presentations to corporate counsel on case developments, matters of law and legal recommendations.
• Preparing corporate representatives and other witnesses for deposition, developing individualized preparation strategies, conducting mock deposition examinations and obtaining affirmative testimony at deposition to support long-term litigation objectives.
• Managing time-sensitive litigation projects across attorneys, clients and support staff by organizing workstreams, assigning responsibilities, monitoring deadlines and ensuring proper and timely execution.

Class Actions & Complex Litigation

• Obtained denial of class certification in a California class action involving novel CLRA and UCL claims by leading the defense strategy, expert development, discovery, briefing and oral argument. Directed an early targeted defense strategy in coordination with the defense expert to develop the evidentiary record to defeat certification, handled all fact and expert depositions and managed a team of junior associates, paralegals, research librarians and litigation support professionals.
• Excluded plaintiff’s expert witness at the class certification stage in a California class action following a targeted expert deposition strategy.
• Obtained damaging testimony from the named plaintiff class representative during deposition, resulting in a voluntary dismissal two days later. Subsequently secured a ruling denying the plaintiff’s motion to tax costs, allowing the client to recover litigation costs.
• Defended a national sports nutrition company in false advertising litigation involving marketing claims and negotiated multiple favorable settlements.

Commercial Litigation, Mediation & Arbitration

• Represented a national charitable nonprofit foundation at mediation and facilitated over $1,000,000 settlement for the client.
• Obtained six-figure settlement for a multimillion-dollar global fashion and apparel company in arbitration in a complex commercial dispute involving fulfillment matters.
• Defended prominent national real estate brokerage in multiple lawsuits involving complex real estate disputes. Directed litigation strategy and handled discovery, motion practice, hearings, mediations and day-to-day case management.
• Obtained dismissal with prejudice of a federal action through successful motion to dismiss on behalf of multinational entertainment electronics company in case involving trademark and copyright infringement and unfair competition.
• In an international domain name ownership dispute, successfully briefed and argued a post-judgment motion to intervene and subsequently defeated an application seeking turnover of the client’s domain name. 
• Defeated summary judgment on behalf of a national organic meal delivery company in a complex supply and distribution dispute, preserving the client’s claims for trial.
• Defended a multinational luxury goods company against a vexatious litigant in a commercial dispute by defeating multiple motions, leading to settlement before trial.
• Obtained dismissal of New York breach of contract action against a regional real estate investment firm through a successful motion to dismiss.  
• Obtained summary judgment on behalf of the plaintiff real estate investment management group in Montana for breach of contract, enabling the client to recover its damages.
• Defended an architecture and design firm in arbitration and pre-litigation matters and negotiated favorable settlements of commercial contract disputes.
• Briefed and argued more than 30 dispositive, procedural and discovery motions, including oppositions to class certification; motions to exclude experts, dismiss, quash jurisdiction, intervene, for and against protective orders, for good faith settlement, to seal, to enforce or quash subpoenas, to bifurcate; demurrers and motions to strike; evidentiary objections; TROs and motions for preliminary injunctions; and summary judgment/adjudication.
• Managed multistate discovery matters, including enforcement of a California subpoena in New York under the Uniform Interstate Depositions and Discovery Act.
• Took and defended multiple party and witness depositions and conducted multiple direct expert depositions and obtained affirmative testimony to support dispositive motions and broader litigation strategy.
• Resolved complex discovery disputes through strategic meet-and-confer negotiations with counsel, discovery motion practice and management of document productions.
• Drafted arbitration and mediation briefs, demand letters, pleadings, discovery, settlement agreements and releases across multiple commercial litigation matters.
• Negotiated favorable settlements in numerous commercial disputes, including through direct negotiations and in mediation.
