When Arbitration Isn't the Best Option 

Panelists will discuss the perceived pros and often unintended cons of commercial arbitration as a mandatory remedy for contract disputes, based on recent experiences and reported matters. For any business that either includes arbitration agreements in the contracts it writes or is subject to them in contracts it receives from third parties, this session will help you thoughtfully evaluate whether to agree to arbitration as the remedy for disputes arising out of those contracts.

Agenda

  • After attending this session, participants will be able to argue that arbitration expenses have increased significantly and can be significant leverage for opposing party in certain circumstances.
  • Participants will develop an understanding of limitations of arbitration, including learning about: 
    • Limited discovery, including third party discovery in arbitration 
    • Limited appellate rights in arbitration absent exceptional circumstances
    • Potential difficulty with enforcement of certain aspects of award

Preparing for the Workplace of the Future

Multi-state hiring and the rapidly accelerating pace of legal and technological change are leaving permanent marks on workplaces. This session will prepare employers with the latest information about compliance, enforcement, and litigation trends like AI use in setting pay, as well as address emerging issues for benefit plan fiduciaries related to alternative investments, health & welfare plan risks, and the increase in ERISA class action litigation.
