Kyle Elzey helps clients navigate the legal complexities of cybersecurity incidents, offering clear direction when timing, confidentiality and business continuity matter most. He assists with investigations arising from a range of incidents, including ransomware attacks, business email compromise, vendor breaches and data leaks.
When an actual or suspected data privacy or security incident occurs, Kyle provides legal guidance while coordinating with internal teams and external partners, including forensic investigators and communications professionals, to identify, contain and mitigate the event while limiting legal, financial and operational harm. He supports clients from initial containment through investigation and notification, evaluating notification obligations under applicable state and federal law and helping organizations develop response strategies that account for related regulatory and business risks.
In addition to incident response, Kyle advises clients on cybersecurity risk management and data privacy compliance, including data protection requirements and the development of policies and procedures that address cybersecurity risk. He also conducts information technology and intellectual property due diligence in mergers and acquisitions, addressing the use, transfer and retention of these assets, as well as post-closing compliance with applicable privacy laws.
A U.S. Army National Guard veteran, Kyle supported the U.S. Department of Defense (DoD) for over a decade in both uniformed and civilian capacities before practicing law. During that time, he helped conduct military cyber operations, shape cyber policy and federal acquisition regulations, and develop and implement the DoD Cybersecurity Maturity Model Certification (CMMC) Program. His work with U.S. Cyber Command, Army Cyber Command, the Pentagon and the DoD Chief Information Officer gave him a deep understanding of threat vectors, advanced persistent threats and cybersecurity best practices. This experience informs his practice today, helping clients identify vulnerabilities, anticipate threats and navigate evolving state and federal privacy laws.
