Michael has represented lenders and creditors in state and federal courts for more than 35 years. He has defended numerous claims against lenders throughout the country, including breach of fiduciary duty and Ponzi schemes, UCC Article 3, 4 and 9 claims, RICO and Regulation B claims, fraud claims, and a variety of other lender liability and class action claims. His experience includes the successful defense of a number of banks in “bet-the-company” cases. Michael has also assisted lenders in resolving problems involving deposit accounts, check and wire issues, complex transactions, and other potential claims before they give rise to litigation.
Michael has also prosecuted numerous claims for lenders, including receiverships and loan recovery actions, UCC foreclosures, fraud claims, injunctive relief, and a variety of other actions. His experience includes complex, multi-jurisdictional receiverships and litigation involving a wide range of loans, customers, and bank issues. Michael has successfully recovered money and assets for lenders where others have failed. A skilled litigator, Michael has obtained judgments and settlements totaling millions of dollars in cases involving loan enforcement, asset recovery, foreclosures, and fraud.
He brings experience and creativity to the enforcement and resolution of problem loans and issues, and the defense of his clients, which include national banks, state-chartered and community banks, nationwide loan servicers and mortgage companies.
