Master-Planned & Large-Scale Development Projects

  • Serve as lead outside counsel to a Colorado-based master real estate developer with respect to projects across the U.S. totaling over $5 billion in aggregate. Representation includes project development and financing, including both credit facilities and real estate secured loans, and equity fund formation and joint venture agreements as well as opportunity zone investments.
  • Represent a real estate company with respect to all development and transactional matters for a 1,100-acre mixed-use master development in Colorado.
  • Representing the owner of approximately 9,000 contiguous acres in Johnson County, Kansas, containing an army ammunition plant, in establishing the largest Tax Increment Financing District in the State of Kansas’s history relating to the construction and incentivizing of a $4-5 billion lithium-ion battery plant.
  • Represent a global engineering firm in its $1.2 billion development of a new world headquarters campus in Overland Park, Kansas, including one million square feet of office space, 1,900 residential units, retail and hospitality, as well as 5,900 structured parking stalls. Our representation included approximately $250 million in public incentives for the project’s financing.
  • Serve as outside general counsel to a New York-based investment manager in connection with its land bank and development of two multi-hundred-acre, single-family residential projects in Tennessee.
  • Represented a commercial transportation company in the issuance of $3.15 billion in revenue bonds for the development of a 310,000-square-foot headquarters facility in Kansas City, Missouri.

Industrial & Logistics Development

  • Since 2012, represented the largest industrial real estate developer in the U.S. on over 300 development projects.
  • Serve as lead outside counsel to a full service national commercial real estate company specializing in industrial development, including assisting with the negotiation and issuance of millions of dollars in government incentives for their projects across the U.S.
  • Serve as outside counsel to one of the largest developers in the Kansas City metropolitan market in developing industrial/distribution warehouses, multifamily and office real estate. Representation includes work related to entitlements, economic development incentives, acquisition, leasing, financing and refinancing.
  • Served as lead counsel in connection with the $294 million development and sale of cold storage assemblages in Arizona, Nevada, Texas, Georgia and Pennsylvania.
  • Represented a real estate developer focused on industrial assets in connection with its $130 million development of a 337,000-square-foot cargo facility in Milwaukee, Wisconsin.

Data Center & Digital Infrastructure Development

  • Represent a developer of large-scale digital infrastructure campuses in their $5+ billion development of a new data center complex in New Mexico.
  • Represented a property developer focused on data center and industrial projects with the approval of rezoning of approximately 550 acres of land in Wyandotte County, Kansas, to develop the property to consist of approximately 1.98 million square feet of data center buildings with an estimated value of $12 billion.
  • Represent a data center developer in the acquisition and development of data centers throughout the southeast U.S.

Corporate, Mixed-Use & Adaptive Reuse Development

  • Represented a Colorado-based real estate development company in the redevelopment of a manufacturing site for a new corporate headquarters campus, including assisting in securing zoning, tax incentives, financing and design and construction agreements.
  • Serve as lead outside real estate counsel for an owner of ski resorts across the world in its development of multiple properties, including ground lease and sale transactions, for a cohesive hotel, condominium, single-family residential, employee housing and timeshare projects.
  • Represented a Colorado-based real estate firm and its affiliate in the redevelopment of a former department store in Boulder, Colorado, into a 160,000-square-foot, Class A office building, including land use and entitlements and the negotiation of development agreements, easements and declarations.
  • Represent a national real estate development company regarding the negotiation and pursuit of development incentives to enable redevelopment of a regional shopping center in Kansas City, Missouri, including approximately 1.1 million square feet of new and refurbished retail, restaurant, multifamily, hotel, office and other commercial space.
  • Represented a not-for-profit organization in connection with the acquisition, entitlements, financing, including public incentives and other project-related approvals in connection with the development of a $350 million agriculture showcase and learning and discovery campus totaling approximately one million square feet.

  • Represent a Chicago-based real estate investment firm specializing in the development of diverse commercial real estate assets, including office spaces, self-storage facilities, multifamily residences and retail projects in development matters across its $4.9 billion portfolio, including acquisitions, financing and associated documentation.
  • Represent a real estate investment and development company that invests in and develops office, industrial, retail and mixed-use projects across the U.S.
  • Advise an Illinois-based real estate development firm with multiple $300 million build-to-suit development projects in Illinois, Wisconsin and Indiana.
