Discharging Student Loans in Bankruptcy
Author, Saint Louis University Law Journal
Zachary Langrehr examines the proposed Private Student Loan Bankruptcy Fairness Act of 2019 and its potential impact on the dischargeability of private student loans in bankruptcy. He explores the competing policy arguments surrounding the legislation, including expanding financial relief for distressed borrowers while weighing concerns about abuse of the bankruptcy system and increased costs in the private student loan market. Langrehr concludes that any changes to the treatment of private student loans in bankruptcy must carefully balance meaningful debtor relief with the long-term stability and accessibility of private educational lending.
