Joshua M. McCaig is an experienced commercial litigator with specialization in health care and intellectual property law, as well as consulting for faith based organizations.  A significant portion of Joshua’s practice is devoted to defending against high-stakes catastrophic injury cases, including complex spinal cord injury and brain trauma. 

For over 20 years, Joshua has worked within the health care industry and his entire legal career has been devoted to defending hospitals, multi-disciplinary health systems and all specializations of health care providers against various claims of liability, including claims involving corporate negligence, professional negligence, medical staff litigation, cyber-attacks, privacy breaches, medical device defects, state and federal investigations, and state medical board complaints and hearings.  

In line with his love of science and technology, Joshua is also a registered patent attorney who enjoys working with clients to advise them on intellectual property needs.  He has litigated patent, trademark and copyright cases nationally, and has successfully resolved complex intellectual property matters through trial and skilled negotiations.  

Joshua is consistently recognized by his peers as a preeminent lawyer in the areas of health care litigation, medical malpractice defense and intellectual property litigation with an AV rating by Martindale Hubbell, earning its highest level of professional excellence.  He has also been recognized as a Missouri & Kansas SuperLawyer since 2011.

In addition to his litigation practice, Joshua regularly is asked to serve as a consultant for non-profits and faith based organizations.  Joshua’s consistent success at leading new initiatives has led to a national and international reputation that makes his insights on start-up process, branding and marketing, legal organization, fundraising, staffing and hiring, and regulatory issues highly sought after.

Joshua has received various awards for his personal and professional achievements, including being honored as the recipient of the Alumni Lifetime Achievement Award by Ave Maria School of Law, the Franciscan University of Steubenville Alumni Citizenship Award and the St. Thomas More Award by the Catholic Lawyers Guild of Kansas City.  Joshua is also a recipient of the prestigious Up and Coming Lawyer Award by Missouri Lawyers Weekly.  

  • Successfully defended a national health care provider against claims arising from an outbreak related to water contamination, which included significant media and public relations strategy, closely working with the State health department and the Center for Disease Control, and analyzing the sources of the outbreak and evaluating the legal options available to my client. 
  • Successfully defended a software company against a cyber-attack resulting in stolen proprietary product, which included investigation of the breach, working with local and federal law enforcement to identify and locate the perpetrator and participation in the questioning of the individual, with successfully securing the stolen product and recoupment of all attorney costs for client.  
  • Defended a national purveyor of food products against claims of trademark infringement and fraud, resulting in a successful negotiation and resolution of the case.  
  • Defended a university against claims of copyright infringement related to a photograph of a national figure who happened to be an alumni of the university.  
  • Defended a property management company against claims related to tenants’ exposure to mold on the property, including the investigation of the claims, coordination of environmental testing and sample preservation, and litigation of the claims.  
  • Successfully defended multiple complex spinal cord injury cases, involving both general liability and professional negligence.  
  • Involved in the litigation of various product liability cases, including knee replacement products, spine surgery products, transvaginal mesh, diacetyl, and other medical devices.
